The following terms and conditions of sale (these "Terms and Conditions"), are agreed to by super8arena.com ("Seller") and the purchaser ("Purchaser"). Seller’s acceptance of any order is subject to these Terms and Conditions. No contrary, additional or different terms, provisions or conditions shall be binding on Seller unless accepted by Seller in writing. This document represents the full and final agreement of the parties regarding these Terms and Conditions.
§ I Order
By placing an order via this web site, the Purchaser makes an offer to purchase the product he or she has ordered on these terms and conditions. Seller has not accepted Purchaser’s offer and is not obliged to supply the product until Seller has shipped the product and sent an order confirmation to the Purchaser by email. Seller may verify Purchaser’s method of payment, shipping address and/or tax exempt identification number, if any, before processing order. If Seller declines to accept Purchaser’s order, Seller will attempt to notify the Purchaser using the email address or other contact information provided with Purchaser’s order. There’s no need to create an account first in order to purchase from this web site.
§ II Prices and Payment
The prices for all products and services displayed for sale on this web site are in Euro (€), exclusive of VAT, F.O.B. Seller’s place of business. Delivery may be charged in addition, and any such additional charges are clearly displayed under "Shipping Charges", where they apply.

§ IV Delivery
Delivery timescales/dates specified on this web site, in any order acknowledgement, acceptance or elsewhere are estimates only. While the Seller endeavours to meet such timescales or dates, he does not undertake to dispatch products and/or commence services by a particular date or dates and shall not be liable to the Purchaser in respect of delays or failure to do so. Seller shall deliver all products to a carrier for transport to Purchaser’s delivery address, with all costs of transport borne by Purchaser.
Delivery shall be to a valid and correct address submitted by Purchaser. Seller reserves the right to charge the Purchaser for any extra costs arising from providing an incorrect delivery address. Incorrect address information would include: missing apartment or suite number, wrong house number, missing company name, wrong zip, incorrect state, multiple addresses listed in the street field, or any other error which would render the package undeliverable resulting in it being either returned to the Seller, or held for correct address information by the carrier.
Purchaser outside of the European Union (EU) agrees to assume exclusive liability for customs clearance, brokerage charges, import duties and taxes, which may be levied when the product reaches the specified destination outside of EU. Any such additional charges must be met by the Purchaser, since the Seller has no control over what these charges are. The Purchaser should contact the local customs office in the relevant jurisdiction for further information on customs policies or duties. Delivery can be delayed if such order is stopped by local customs and/or liable to customs duty. All deliveries within the EU are duty free.
§ V Delivery Problems
All purchases from this web site are made pursuant to a shipment contract. All products are properly packaged and protected, therefore damage in transit is the responsibility of the carrier. The Purchaser is responsible for filing any claims with the carrier for damage. The Seller is responsible for filing any claims with the carrier for lost shipments. If a package appears damaged when the Purchaser
receives it, it is his responsibility to indicate the condition of the package on the receipt from the carrier.
If the package does not appear to be in good condition, then the Purchaser should refuse the delivery. Failure to do so may affect any warranty claims made thereafter. If damage is discovered upon opening the package, the Purchaser must notify the carrier and the Seller immediately (recommended time frame is: less than 3 calender days). Damage claims are handled through the carrier and the Seller will make every effort to assist the Purchaser in reaching a satisfactory adjustment with the carrier. To claim damage in transit, Purchaser must retain packing materials for carrier inspection.
In the case of non-delivery, Seller will file a claim with the carrier 3 days after the maximum estimated delivery date for the applicable order. Estimated delivery times are displayed on the shipping info page on this website and are provided by the carrier(s). They do not include potential delivery delays. Such delays may be due to situations, events, circumstances beyond control such as Purchaser not being available to accept delivery, delays in transportation, acts of nature, human error, mechanical or technical errors and faults or due customs clearance procedures and/or schedules at the country of delivery. Once the claim is admitted by the carrier, Seller will reimburse the Purchaser in full in less than 3 business days.
§ VI Returns Policy
super8arena.com grants a 31-day return guarantee on all orders through its website. Purchaser has the right to cancel the contract at any time up to 31 calender days after product is received. To exercise the right of cancellation, Purchaser should give written notice to the Seller through Your Account --> Order History --> Request A Return and obtain a return authorization number (RMA). Or in writing via Contact Us form or directly by email to

within 31 calender days of receipt of the product, giving details of the goods ordered and send it back within 31 days of the date it was delivered to the Purchaser.
Except in the case of defective or incorrect goods, the Purchaser will be responsible for the original shipping charges and the costs of returning the product to the Seller. The product must be returned to the address shown on the original invoice or in "Your Order History" section of this website. The Purchaser must take reasonable care to ensure the goods are not damaged in the meantime or in transit. For maximum protection a recorded-delivery service combined with original packing materials is recommended.
In the case of defective or incorrect goods, the Purchaser must contact the Seller within 24h of receipt and ship them back within 3 calendar days of delivery. Once Seller has confirmed the receipt of returned product and/or verified the fault, he will issue the Purchaser (at his discretion) a replacement or refund via original payment method and, in the case of defective, incorrect or significantly misdescribed goods, reimburse Purchaser’s reasonable return carriage costs.
Return carriage costs will be refunded in full as long as they do not exceed shipping to Purchaser’s location. Seller will refund or re-credit the Purchaser in less than 21 days after returned product has been received. Any returned product that is found not to be defective or incomplete is subject to a 12.5% service fee and will be returned at Purchaser’s expense. Purchaser does not have the right to cancel the contract if the order is for sealed products which have been unsealed, or for consumable products which, by their nature, cannot be returned.
§ VII Warranty
All products supplied by the Seller are warranted free from defects for 90 days from the date of supply. If the product develops a defect or you have any other complaint about it during the 90 days warranty period, you should notify the Seller in writing via Contact Us form or directly by email to

In the event of a valid claim for a defect in the product, where clauses 4 or 5 do not apply, the Seller will (at its option) either:
- 1. repair this product
- 2. replace this product, if the Seller has available the same product at the same price
- 3. refund or re-credit the Purchaser the sum he has paid for the relevant product within 21 calender days of the date that the relevant product is returned in accordance with Seller’s returns procedure (see § VI Returns Policy).
The warranty in clauses 1, 2 and 3 above does not apply to any defect in the product arising from fair wear and tear, wilful damage, accident, negligence by the Purchaser or any third party, use otherwise than in accordance with its intended use, failure to follow the manufacturer’s or Seller’s instructions, or any alteration or repair carried out without Seller’s prior written approval.
- 4. If the product supplied to the Purchaser is faulty on arrival (it was not damaged in transit), the Purchaser must notify the Seller within 3 calendar days of receipt of the product and return the product to the Seller in accordance with Seller’s returns policy (see § VI Returns Policy). Once Seller has verified the fault, he will issue the Purchaser with (at his discretion) a replacement or full refund via Purchaser’s original payment method and reimburse Purchaser’s reasonable return carriage costs.
- 5. If the product is damaged in transit, the Purchaser shall follow the instructions described in § V Delivery Problems. The purchaser should also notify the Seller by requesting a return through Your Account --> Order History --> Request A Return. Or in writing via Contact Us form or directly by email to

§ VIII Limitation of Liability
As far as these Terms and Conditions do not state anything to the contrary there are no further Purchaser claims applicable (regardless of reason). In particular, Seller is not responsible for any defects that have not originated on the product itself, particularly not for loss of profit, cost of rentals, lost fees or other expenditures.
§ XI Product and Service Quality
Purchaser is aware that all products are used equipment and understands that most products described herein have been used by persons other than the Seller. All used equipment is carefully selected and fully checked and/or serviced before being offered for sale. While considerable effort is taken to faithfully describe and illustrate all products, some variation may occur through Purchaser’s web browser software or computer system that Seller can not control. Every effort is taken to ensure the information provided on this web site is accurate and if any of it appears to be unclear, Purchaser shall contact the Seller.
§ X Governing Law and Jurisdiction
The Purchaser agrees that the law of the Federal Republic of Germany is effective, exclusive of the international commercial law. Place of jurisdiction - for any claim or controversy, directly or indirectly arising out of this business connections - is the local court at super8arena.com domicile. If single definitions of the delivery contract or the general terms and conditions are ineffective, the remaining provisions stay effective. On border-crossing deliveries, german law is effective.
§ XI Changes to these Terms and Conditions
Seller reserves the right to change these Conditions of Use at any time and without giving any reasons. The respective latest version is part of our website.
